WARRANTY TERMS AND CONDITIONS
Unicorn Automotive Sp. z o.o.
- These Warranty Terms and Conditions define the scope and rules of the warranty provided by Unicorn Automotive Sp. z o.o. for special vehicle bodies, box bodies (containers), and other products manufactured by Unicorn Automotive Sp. z o.o.
- This warranty is voluntary and shall apply exclusively under the terms and conditions specified herein.
- The warranty is valid within the territory of the Republic of Poland and the Member States of the European Union, subject to the repair location specified in Section 7.
- In transactions concluded between business entities, the Parties agree, pursuant to Article 558 §1 of the Polish Civil Code, to exclude the statutory warranty (warranty for defects) to the fullest extent permitted by applicable law.
- Unicorn Automotive Sp. z o.o. grants a warranty for a period of 24 months from the date of delivery of the vehicle to the Customer.
- The warranty covers only defects resulting directly from material defects, manufacturing defects or technological defects attributable to Unicorn Automotive Sp. z o.o.
- Repair or replacement of any component during the warranty period shall not extend or renew the original warranty period. The warranty expires upon expiration of the original warranty term.
The warranty applies exclusively to components manufactured by Unicorn Automotive Sp. z.o.o.
At its sole discretion, the Manufacturer may:
- repair the defective component,
- replace the defective component,
- replace the complete assembly.
The method of remedy shall be determined solely by Unicorn Automotive Sp. z o.o.
- 4. Components Excluded from Warranty
The warranty does not cover consumable parts or components subject to normal wear and tear during regular operation, including but not limited to:
- locks,
- lock cylinders,
- keys,
- hinges requiring adjustment,
- cables,
- Bowden cables,
- control linkages,
- springs,
- seals,
- light bulbs,
- fuses,
- batteries,
- windshield wiper blades,
- rubber components,
- adjustment mechanisms,
- lubricants,
- operating fluids,
- any other consumable materials.
Normal wear and tear of the above-mentioned components shall not constitute a product defect.
Repair or replacement of these components shall be performed exclusively on a chargeable basis.
The warranty shall not apply to defects or damage resulting from:
- improper use,
- use contrary to the intended purpose,
- vehicle overloading,
- failure to perform required inspections,
- improper maintenance,
- incorrect installation of additional equipment,
- unauthorized modifications,
- interference by third parties,
- repairs carried out without the Manufacturer’s approval,
- use of non-approved spare parts,
- road accidents,
- collisions,
- force majeure,
- fire,
- flooding,
- hail,
- lightning,
- vandalism,
- exposure to chemicals,
- corrosion resulting from mechanical damage,
- normal wear and tear.
The warranty also excludes adjustments resulting solely from normal operation of the vehicle.
- 6. Limitation of Liability
Unicorn Automotive Sp. z o.o. shall not be liable for:
- loss of profit,
- loss of business,
- loss of use of the vehicle,
- rental vehicle costs,
- towing costs,
- transportation costs,
- accommodation expenses,
- travel expenses,
- indirect damages,
- consequential damages,
- contractual penalties imposed on the Customer by third parties.
- 7. Place of Warranty Repairs
- All warranty repairs shall be carried out exclusively at the production facility of Unicorn Automotive Sp. z o.o.
- The Manufacturer does not operate a mobile warranty service.
- The Owner shall deliver the vehicle to the Manufacturer’s production facility at the Owner’s sole cost and risk.
- Collection of the repaired vehicle shall also be at the Owner’s sole cost and responsibility.
- The Manufacturer shall not reimburse transportation or towing expenses.
- 8. Repairs Performed by Third Parties
- Any warranty repair performed outside Unicorn Automotive Sp. z o.o. requires the Manufacturer’s prior written approval.
- Approval shall be granted only after submission of:
- a description of the defect,
- photographic documentation,
- a repair cost estimate.
- Any repair commenced without the Manufacturer’s prior written approval shall automatically exclude reimbursement of repair costs.
- The Manufacturer shall reimburse only those costs that have been approved in writing in advance.
- 9. Warranty Claim Procedure
A warranty claim shall include:
- Vehicle VIN,
- body serial number,
- description of the defect,
- photographic documentation,
- date on which the defect was discovered.
The Manufacturer reserves the right to request any additional information necessary for proper assessment of the claim.
- Warranty repairs shall be completed within 14 working days from the date the vehicle is delivered to the Manufacturer’s production facility.
- If repair requires procurement of special parts, manufacture of custom-made components or complex technological operations, the repair period may be extended to 30 working days.
- The repair period shall be extended accordingly in the event of circumstances beyond the Manufacturer’s reasonable control.
- 11. Loss of Warranty Rights
Warranty rights shall expire in the event of:
- repairs performed without the Manufacturer’s approval,
- unauthorized structural modifications,
- installation of non-approved equipment,
- failure to follow the Manufacturer’s instructions,
- failure to perform mandatory inspections,
- removal or damage of identification plates,
- unauthorized modification of the body electrical installation.
- This warranty covers solely the obligation to remedy defects covered under these Warranty Terms and Conditions.
- This warranty shall not constitute grounds for withdrawal from the purchase agreement or replacement of the entire vehicle unless mandatory provisions of applicable law provide otherwise.
- Matters not regulated herein shall be governed by the applicable provisions of Polish law, including the Polish Civil Code.
- In the event of sales to consumers or entities benefiting from consumer protection under applicable law, these Warranty Terms and Conditions shall apply only to the extent permitted by mandatory legal provisions.
